Gaming1 attaches great importance to personal data protection. We therefore take all necessary measures to protect the privacy of users (hereinafter "Users") who visit and use the Gaming1 site (hereinafter "Site").

The following informs Users about the provisions governing the processing of personal data during any visit to or any use of the Site by the Users (hereinafter the "Privacy Policy").


1. General information

Gaming1 processes personal data belonging to Users of the Site for the purposes and subject to the limits of the Privacy Policy, during each visit or each use of the Site.

When processing personal data, Gaming1 must comply with the laws and regulations in force, namely Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to personal data processing (hereinafter the "Regulation").

In this regard and in accordance with this Regulation, Gaming1:

  • will process the listed personal data for the purposes determined in Article 2, subject to the prior, free and express prior consent of the Users;
  • process personal data in order to allow Users to use the Site for the necessary and legitimate purposes set out in Article 3 of the Privacy Policy

By accessing and using the Site, Users acknowledge that they have read and accept this Privacy Policy.


2. Personal data processing subject to prior User consent

By visiting or using the Site, for any reason whatsoever, the User gives their free, individual, informed and explicit consent to expressly authorize Gaming1 to process personal data in application of the Regulation, within the limits and for the purposes set out below, without prejudice to the data processing set out in Article 3.

The personal data provided by the User is kept in a file managed by Gaming1 and under its responsibility at all times, in accordance with Article 7.1.

2.1. Gaming1 processes the following personal data :

  1. surname(s), first name(s), company name, postal address, email address, landline or mobile telephone number;
  2. data relating to cookies, in accordance with Article 7.3;
  3. any other information that would be exchanged between Gaming1 and the User, whether by email, during registration or when the User uses the Site.

2.2. Data processing

Processing involves the collection, recording, storage, querying, organization, use and checking of personal data in accordance with Article 2.1.

2.3. Purposes of personal data processing

Personal data is collected and processed by Gaming1 for the following purposes :

  1. to launch new B2B games and sports betting offers;
  2. for satisfaction surveys, statistical studies, trend analyses and market research in order to improve our gaming and sports betting services;
  3. to carry out promotional, advertising and marketing activities related to the B2B offer of gaming and sports betting services, including the processing of personal data by third parties.

3. Processing of personal data where prior User consent is not required

Gaming1 will process the following personal data for the legitimate purposes set out below. The processing of personal data by Gaming1 does not require the consent of the Users, in accordance with Article 6.1.f) of the Regulation.

The personal data provided by the User is kept in a file managed by Gaming1 and under its responsibility at all times, in accordance with Article 7.1.

3.1. Nature of the processed data

Gaming1 processes the following personal data:

  1. surname(s), first name(s), company name, postal address, email address, landline or mobile telephone number;
  2. any other information that would be exchanged between Gaming1 and the User, whether by email, during registration or when the User uses the Site.

3.2. Data processing

Processing involves the collection, recording, storage, querying, organization, use and checking of personal data in accordance with Article 2.1.

3.3. Legitimate purposes of data processing

Gaming1 will process the personal data set out in Article 3.1. for the following legitimate purposes:

  1. to promote, advertise and market B2B games and sports betting offered by land-based or online gambling operators;
  2. for satisfaction surveys, statistical studies, trend analyses and market research in order to improve our gaming and sports betting services.

4. User rights

Users may exercise their rights to request that their personal data be rectified, to object to their data being processed and to limit it, in accordance with the conditions and within the limits set out below.

4.1. Right of access

Gaming1 will provide Users with the following information :

  • the name and contact details of the data controller;
  • the contact details for the data protection officer;
  • the personal data processed;
  • the purposes for which the personal data is being processed and the legal basis for this processing;
  • the recipients or categories of recipients of the personal data, if applicable;
  • where applicable, the fact that the data controller intends to transfer personal data to a country outside the European Union and the fact that the European Commission has (or has not) adopted an appropriate decision. In the event that such a decision has been adopted, Gaming1 sends the User the guarantees provided by the country outside the EU and the resources put in place to obtain copies of the personal data transferred;
  • the possibility of objecting to the automatic processing of their data, including profiling, except in the event of a justified reason requiring Gaming1 to process the data, as well as the possibility of objecting to any processing of their personal data for marketing purposes.
  1. Users have the right to request the information referred to in this article and in Articles 2.1 and 3.1.
  2. Users can get a copy of the personal data processed. For any additional copy requested, Gaming1 reserves the right to demand payment of any costs incurred in connection with this new request. These costs will be calculated on the basis of the administrative fees incurred in connection with this request and will not exceed 20 euros.
  3. Users will have the right to access the information, or a copy thereof, in a structured format, so that the personal data will be provided to them in a format that meets the technical standards in force when the access request is made. This format will therefore allow automatic readability.

4.2. Right to request rectification

Gaming1 guarantees and requires users to update and rectify their personal data if it becomes inaccurate or incomplete.

4.3. Right of opposition to data processing

Gaming1 authorizes Users to object in whole or in part to the processing of their personal data for the following reasons :

  • the data is inaccurate;
  • the personal data processing is no longer required for the purpose for which they were collected;
  • the User has withdrawn their consent;
  • the data has been processed illegally.

In addition, Gaming1 allows Users to oppose :

  • the automatic processing of their data, except in the event of a justified reason requiring Gaming1 to carry out this processing;
  • to the processing of their personal data for marketing purposes, including profiling where appropriate.

4.4. Right to be forgotten

Gaming1 also undertakes to respond to any request to erase personal data as soon as possible (right to be forgotten) when :

  • the personal data processing is no longer required for the purpose for which they were collected;
  • the User has withdrawn their consent;
  • the data has been processed unlawfully or must be erased by virtue of a legal obligation;
  • the User opposes the automatic processing of their data, including profiling, and no justified reason requires Gaming1 to carry out this processing;
  • the User opposes the processing of their personal data for marketing purposes, including profiling where appropriate.

4.5. Right to restrict data processing

Users have the right to limit the processing of their personal data by Gaming1 when :

  • the User considers that the personal data is inaccurate, while Gaming1 verifies their accuracy;
  • the processing is unlawful and the User does not want their data to be erased, but requests the processing to be limited;
  • the User opposes automatic processing, including profiling, or the processing of their personal data for marketing purposes, and it is necessary to verify the legitimacy of Gaming1's reasons for continuing this processing;
  • Gaming1 no longer requires the processing of the personal data, but the User in question wants the data to be kept in order to establish, exercise or defend legal action.

4.6. Transfer of data to a data controller

Users can transfer the personal data processed by Gaming1 to another data controller without objection from Gaming1.

For such a transfer to be technically possible, Users can ask Gaming1 to instruct its data controller to proceed directly to the transfer.

4.7. Terms and conditions

The rights granted to the User must be exercised in accordance with the terms and conditions described in Article 7.5. Gaming1 shall respond to these information requests within one (1) month.

4.8. Notification

Gaming1 shall notify the User of any data erased or corrected in accordance with Article 4, except in the event that the notification is impossible or requires disproportionate efforts.

This notification will be sent by letter or email to the contact address / email address provided by the User.


5. Location, retention and retention period of personal data

Gaming1 holds Users' personal data in an appropriate and secure manner that enables them to be identified and made accessible.

The data are stored and hosted in the European Union. Gaming1 provides all the required and necessary security guarantees in accordance with the technical rules in force.

Gaming1 retains Users' personal data for the purposes set out in Articles 2 and 3, for a period that does not exceed the time necessary to achieve the purpose of the processing, for all purposes governed by Articles 2 and 3.


6. Gaming1’s liability - Data processing

6.1.

Gaming1 guarantees that personal data is processed legally, fairly and transparently with regard to the User concerned. Any data processing performed by Gaming1 will comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to personal data processing as well as to this Privacy Policy.

Gaming1 will use all reasonable and appropriate means to guarantee the confidentiality, integrity and accessibility of the personal data processed. These technical and organizational means are listed in the data protection manual, which can be obtained through the contact person indicated in Article 7.5.

The technical means include anonymization and encryption of personal data, depending on the purpose.

Organizational resources include internal audits, in addition to audits to which Gaming1 could be required to undergo by the Belgian or Maltese gambling authorities.

Where applicable, Gaming1 and the Data Protection Officer will carry out an impact assessment when data processing is likely to present high risks for Users.

6.2.

Users' personal data is not sent to any third party other than Gaming1’s partners, except in the following cases:

  • The data transfer is required by law or regulation or has been ordered by an administrative or court authority;
  • The data transfer is necessary to provide online gaming or sports betting services or maintenance services; the data transfer is necessary in order to provide online gaming or sports betting services or maintenance services;
  • The User has given their consent for the transfer

Gaming1 will not be held liable for the processing of Users' personal data by partners who provide services in their own name and will not be held liable for damage caused by personal data processing that breaches the Regulation.

Where the data is processed by a partner on behalf of Gaming1, the latter must provide sufficient guarantees that the appropriate technical and organizational means have been implemented and, more generally, that the Regulation has been respected. In particular, the data controller will have to comply with the Regulation and, therefore, keep track of processing activities.


7. Other

7.1. Retention of personal data

As a personal data controller, Gaming1 keeps a log of all its data processing activities. This log includes all information concerning the type of data processed, the Users concerned, the potential recipients of the data, the purposes of the data processing, the retention period of the data as well as a general description of the technical and organizational protection measures implemented.

This log is managed by Gaming1 and remains under its responsibility at all times. In addition to the aforementioned information, this log includes :

  • a description of the purposes of the processing;
  • a description of the categories of Users and the categories of personal data;
  • the categories of recipients to whom the personal data have been or will be sent, including recipients outside EU countries or international organizations;
  • the time limits for erasing different categories of data

7.2. Entire agreement - updating of the Privacy Policy

The Privacy Policy covers all the contractual provisions binding the User, notwithstanding the legal provisions of the Site of which they are an integral part. The legal provisions of the Site will continue to apply for any point unrelated to the personal data of Users.

In addition, Gaming1 reserves the right to modify the Privacy Policy. Once published on the Site, any update is binding on Users. Gaming1 undertakes to mention the date on which the Privacy Policy on the Site was put online.

7.5. Data protection authority

Under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, the User has the right to request additional information or file a complaint with the data protection authority.
